Description of Rewards.com
Rewards.com is a consumer website for anyone interested in rewards. We maintain this great destination for all things rewards as a service for our members, potential members, and other interested parties. Please visit our website often via www.Rewards.com to browse our specially designed pages, and earn as many Rewards as you can. All rewards are subject to the terms and conditions as outlined here and may be updated from time to time with or without notice.
Rewards.com is an online program managed, operated and maintained to allow MEMBERS to earn REWARDS including, but not limited to, CASH BACK for specific online purchases initiated on this SITE. The SITE is provided by Rewards.com and may allow you to access other websites. By accessing or using the SITE, you agree to comply with and be bound by these Terms and Conditions (the "AGREEMENT").
The SITE includes, without limitation: (a) all websites, co-branded microsites, applications owned or provided by Rewards.com, all SERVICES offered on www.Rewards.com, and other SERVICES accessible via www.Rewards.com; (b) all SOFTWARE offerings and applications owned or provided by Rewards.com and/or available on www.Rewards.com; and (c) web pages, data, text, images, photographs, graphics, audio, video, and documents including, without limitation, offers and coupons, marketing materials, press releases, white papers, product data sheets, and other information and CONTENT available or submitted on www.Rewards.com.
- AWARD/S: The disbursement of a cash back reward to an individual that is provided by Rewards.com to MEMBER after they have made a qualifying purchase through the program.
- REWARD/S: Enrolled members can earn cash back rebates and other rewards including, but not limited to, bonus cash, cash, points, discounts, coupons and similar qualified benefits.
- PROGRAM: program that is operated and managed by Rewards.com and allows enrolled MEMBERS the ability to earn a portion of their net purchase back in the form of a cash back Rebate/reward.
- COOKIE/S: A segment of data, or message containing information about a computer or user, that a website places on your computer to customize or otherwise enhance your interaction with that website.
- COUPON/S: A certificate or document that entitles consumer to an immediate price reduction when the product is purchased from a participating merchant at Rewards.com.
- EXCLUSION/S: Excluding factors, of Rewards.com, the participating merchant, or both that can contribute to one not earning cash back. Exclusions can be exclusive or inclusive and are not limited to specific products, product categories, or merchants or Rewards.com.
- MEMBER/S: An individual that has enrolled in the Rewards.com Program. Membership is gained by providing Rewards.com with a valid email address and password. After authentication, Members can login to Rewards.com and start earning rewards.
- ACCOUNT: Authenticated account that allows enrolled users of program to login, modify personal setting, and earn cash back on qualified purchases.
- NETWORK/S: The interconnected system that is Rewards.com.
- PARTICIPATING MERCHANT: Retailer that provides Rewards.com with the ability to distribute cash back and/or coupons to members
- QUALIFYING PURCHASE/S: A purchase that is made by an enrolled member that meets all eligibility requirements, of both Rewards.com and a participating merchant, for receiving a reward from Rewards.com.
- SITE: Everything that encompasses the software, content, services and applications offered by the website of Rewards.com
- SERVICE/S: All websites, co-branded Microsites, applications and services owned, operated on www.Rewards.com
- SOFTWARE: All programs, procedures, algorithms and their documentation and development by Rewards.com.
- UNSUBSCRIBE: members choose to opt-out from email communication that provide the member with deals, discounts and exclusive offers from Rewards.com.
- PREFERENCES: An enrolled members ability to choose the frequency that they receive email communication from Rewards.com
- AGREEMENT: Terms and Conditions agreement between Rewards.com and any member or user of the Rewards.com website.
- USER/S: Individual that takes advantage of the coupon service of Rewards.com and does not provide email or password and are, therefore, un-enrolled or authenticated in the Rewards.com program
- CONTENT: All creative, developed, published or produced information and experiences that is provided by Rewards.com.
The SERVICES offered by Rewards.com may change on the SITE at any time without notice. Rewards.com makes no representation that the SITE is available for use in your location, and a reference to SERVICES within the SITE does not imply that the SERVICES will be available to you and/or in your location. The PROGRAM and Rewards are made available strictly on an "as is" and "as available" basis. Rewards.com makes no warranties express or implied that the PROGRAM will be uninterrupted or error-free and reserves the right to change the SERVICES or offers made available on the SITE at any time to correct errors on our part or that of a PARTICIPATING MERCHANT. You agree and understand that any REWARDS are at the sole discretion of Rewards.com whether or not you fulfilled the requirements of the REWARD.
Access to and use of password protected or secure areas of the SITE is restricted to authorized MEMBERS only. You acknowledge and agree that Rewards.com will not be held liable for any lost information or cash back for MEMBERS sharing their password, ACCOUNT information, or access to the SITE with any other MEMBER or non-member of Rewards.com whether intended or not. Depending on the situation and all information taken into account by Rewards.com, you could be held liable for losses incurred by Rewards.com or another due to someone else using your ACCOUNT or password. You also agree not to access or use the SITE in any manner that may damage, disable, unduly burden, or impair any Rewards.com NETWORKS or systems. You agree not to use any robot, spider, or other automatic device, or manual process to monitor or copy our web pages or the content contained therein without prior written permission of an authorized officer of Rewards.com. Rewards.com is not responsible for your inability to connect to the Internet, access the Rewards.com website/s or access a PARTICIPATING MERCHANT website(s).
To join Rewards.com and use the PROGRAM you must be at least eighteen (18) years of age and you must be a resident of the United States. Further, ACCOUNT membership of any type is limited to one ACCOUNT per individual or organization.
This section describes how the PROGRAM works, the rights and responsibilities of the MEMBER, and rights and responsibilities of Rewards.com with respect to the PROGRAM. As a USER of Rewards.com, you have the option to become a Rewards.com MEMBER which requires you to enroll in the SITE. ACCOUNT membership gives you the opportunity to utilize our PROGRAM to earn cash back REWARDS on your own specific QUALIFYING PURCHASES. CASH BACK is paid by Rewards.com and is separate from, and in addition to, COUPONS which provide discounts from orders processed by merchants.
To earn cash back REWARDS you must meet the eligibility requirements. A REWARD will only be paid for a transaction that the PARTICIPATING MERCHANT deems eligible. To qualify to receive a REWARD, you must make a QUALIFYING PURCHASE from the PARTICPATING MERCHANT and Rewards.com will provide you with a portion of your net purchase, which we will then transfer into your Rewards.com ACCOUNT in the form of cash back. A MERCHANT'S details page may or may not state if non-US residents qualify for cash back. MEMBER benefits and SERVICES are offered in good faith, however, may not be available if prohibited by local or federal laws, statutes or ordinances of MEMBERS residence.
As a MEMBER, you are responsible for maintaining the confidentiality of your password, ACCOUNT information and all activities that occur using your password on Rewards.com. If the security of your password, ACCOUNT access or any other ACCOUNT information is jeopardized due to any unauthorized use, you agree to notify Rewards.com immediately. You are responsible for maintaining accurate ACCOUNT information at all times. Rewards.com is entitled to act on instructions conveyed by any MEMBER utilizing his or her username and password in the said manner. MEMBERS are responsible for regularly reviewing their ACCOUNT balances to verify their accuracy and that all cash back REWARDS have been appropriately posted. If a MEMBER finds a discrepancy in his or her ACCOUNT, Rewards.com must be notified within 90 days of the order date to research the discrepancy. The discrepancy may or may not be authorized, at the sole discretion of Rewards.com.
To enroll you must create an authenticated ACCOUNT online at Rewards.com. Once you have created an ACCOUNT you can complete purchases in the PROGRAM. If you choose to create an ACCOUNT, you agree to provide only accurate, complete registration information, and you will keep that information up-to-date. If you provide any information that is untrue, inaccurate, not current or incomplete, or Rewards.com has reasonable suspicion that such information is untrue, inaccurate, not current or incomplete, or you otherwise have violated this AGREEMENT, Rewards.com has the right to suspend or terminate your ACCOUNT and refuse any or all current or future use of the SITE and/or SERVICES (or any portion thereof) including REWARDS, regardless of the status of the REWARD in the MEMBERS ACCOUNT.
Any violation of this AGREEMENT is grounds for termination of your ACCOUNT which encompasses, but is not limited to, your user name, password and enrollment with Rewards.com. Termination of ACCOUNT will result in the forfeiture of any REWARDS that are currently in ACCOUNT balance. Rewards.com reserves the right to discontinue MEMBERSHIP for any MEMBER who appears to be using the PROGRAM in a manner inconsistent with this AGREEMENT or the intent of the PROGRAM or any portion of the PROGRAM. Rewards.com reserves the right to terminate your ACCOUNT if there are reasonable grounds for suspecting fraud, theft, or dishonesty in connection with the ACCOUNT as determined by local, state, and federal laws, statutes or ordinances at the sole discretion Rewards.com. If your ACCOUNT is inactive for eighteen (18) consecutive months, or your ACCOUNT is deemed to be inactive due to no SITE activity. Rewards.com defines SITE activity as an online action that the MEMBER has made on the SITE after he or she has logged in to their Rewards.com ACCOUNT. Once deemed inactive, Rewards.com reserves the right to debit your Rewards.com ACCOUNT balance two dollars ($2.00) per month to recover the cost of ACCOUNT maintenance until you reactivate your ACCOUNT by logging in to your Rewards.com ACCOUNT or your ACCOUNT balance is zero, whichever comes first. If the balance in your inactive ACCOUNT is or becomes zero, Rewards.com will close the ACCOUNT permanently and cease to maintain your ACCOUNT records and PROGRAM access. The Inactive ACCOUNT maintenance charge will not cause your ACCOUNT balance to become negative and will not cause you to owe money to Rewards.com. MEMBERS may terminate their ACCOUNT at any time by sending an email to email@example.com or submitting a customer service inquiry here.
Cash Back & Coupons
General Description of Cash Back
Cash Back REWARDS allows a MEMBER to earn back a portion of their online purchase in the form of a REWARD. After you have enrolled in the PROGRAM, choose a store, product, coupon or other offer displayed on Rewards.com, make sure you are logged into your ACCOUNT and then click the accompanying shopping link to be directed to a PARTICIPATING MERCHANT'S website. Once you complete a QUALIFYING PURCHASE you will earn a cash back REWARD which will be deposited you're your ACCOUNT. Specific cash back amounts vary by PARTICPATING MERCHANT and are provided in detail at Rewards.com. Additionally, each PARTICIPATING MERCHANT has their own EXCLUSIONS for each offer; MEMBERS should verify that they are eligible for a cash back REWARD on Rewards.com. Rewards.com does its best to minimize and maintain an up-to-date list of EXCLUSIONS on the SITE. If you visit other websites during your Rewards.com shopping session, you may not be eligible to receive an AWARD for your purchase. If you disable COOKIES on your computer you will not be able to earn AWARDS. COOKIES are used to verify and authenticate the MEMBER and in some cases track the transaction.
In order for Rewards.com to provide a REWARD, a MEMBER must click on a PARTICIPATING MERCHANT'S link from the PROGRAM and follow certain guidelines to create a QUALIFYING PURCHASE. To create a QUALIFYING PURCHASE you must:
- Be logged into the PROGRAM
- Use only valid links within the PROGRAM to get to a PARTICIPATING MERCHANT'S website.
- Add selected items into your shopping cart and complete the current transaction(s) within the same shopping session in which Rewards.com linked you to the PARTICIPATING MERCHANT's website
- NOT purchase any items specifically excluded by the PARTICIPATING MERCHANT or Rewards.com.
- Use only COUPONS located on the PROGRAM SITE.
Furthermore, if you return an item and wish to replace it, you must go back through the PROGRAM SITE to the MERCHANT to make the replacement purchase. Exchanges done over the phone will not be eligible to earn REWARDS. We cannot provide cash back offers for any purchase made through a secondary Merchant within a PARTICIPATING MERCHANT'S website. If in doubt about whether or not you are in a valid session you should re-enter the PROGRAM website and then click on the "shop now" link for the MERCHANT that you wish to shop at directly, and then complete your transaction. Only purchases reported to Rewards.com by a PARTICIPATING MERCHANT as commissionable will qualify for a REWARD. Please note that AWARDS are made for the net purchase amount only. The net purchase amount excludes taxes, fees, shipping, gift-wrapping, discounts or credits, returns or cancellations and in many cases, gift cards and extended warranties.
Cash Back Process
REWARDS are earned at Rewards.com by making QUALIFYING PURCHASES from PARTICIPATING MERCHANTS. Transactions eligible for cash back will be reported to Rewards.com and your cash back REWARD status becomes PENDING. Orders remain in this status for approximately 40 days to allow for returns/cancellations and other settlements (if any) to adjust. After this period, your REWARD status will change to CONFIRMED and will show in your online account until distribution to you as described herein.
Cash back REWARD payments will be distributed in U.S. dollars ($) on the 25th of each month and at present, can be delivered via mail by a standard check or to your designated PayPal account. For a MEMBER to receive an AWARD payout they must have earned the minimum amount which must be in a Confirmed status in their ACCOUNT-currently $5.00-excluding any bonus cash (Bonus cash is earned without a QUALIFYING PURCHASE from a PARTICIPATING MERCHANT) that may have been provided by the PROGRAM. Additionally, a MEMBER must make at least one QUALIFYING PURCHASE from a PARTICIPATING MERCHANT through Rewards.com. If you have not earned the minimum amount of cash back required for an AWARD to be paid, the amount that you have earned thus far will roll over to the next month. This process will continue until you earn the established minimum amount of cash back that is designated in a Confirmed status. It is solely the responsibility of the MEMBER to be informed about the PROGRAM. Whether or not a purchase is deemed a QUALIFYING PURCHASE is at the sole discretion of Rewards.com. Earned or confirmed cash back REWARD does not constitute property of the MEMBER.
When a cash back AWARD is distributed, the corresponding amount of cash back will be automatically deducted from the MEMBER'S ACCOUNT. The MEMBER is responsible for any fees or taxes that are incurred through the disbursement of cash back AWARD by Rewards.com. These depend on the tax laws of federal, state, and local jurisdictions. Before using the PROGRAM you should research any possible tax implications and seek the advice of a competent tax professional in your area. Rewards.com will not be responsible for or advise you on any taxable liabilities which may be due based on your use of the PROGRAM. Rewards.com may choose to provide related notices on occasion; however, in all instances the MEMBER is solely responsible for any and all tax liability for your ACCOUNT and any AWARDS earned as a result of your use of the PROGRAM.

Limitation of Liability
WE MAKE NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, CONDITIONS OF QUALITY AND FITNESS FOR A PARTICULAR PURPOSE OR ALL IMPLIED WARRANTIES AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A DEALING OR USAGE OF TRADE REGARDING THE SERVICES, MATERIALS, OR GOODS, ADVERTISED, PROMOTED, SOLD OR OTHERWISE MADE AVAILABLE THROUGH A MERCHANT PARTICIPATING IN THE PROGRAM EITHER DIRECTLY OR INDIRECTLY. YOU EXPRESSLY AGREE THAT YOUR PARTICIPATION IN THE PROGRAM AND PURCHASE OF GOODS OR SERVICES FROM A MERCHANT ARE AT YOUR OWN RISK. YOU AGREE THAT NEITHER WE NOR ANY OF OUR AFFILIATES, OFFICERS, EMPLOYEES, OR CONTRACTORS WILL HAVE ANY LIABILITY WHATSOEVER FOR ANY DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING ANTICIPATED REVENUE, SAVINGS OR GOODWILL, LOSS OF PROFITS, LOSS OF REVENUE OR OTHER ECONOMIC LOSS, ARISING OUT OF YOUR PARTICIPATION IN THE PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH AN EVENT.
You agree and acknowledge that we have no control over and are not responsible for the content of, or claims made on, websites of PARTICIPATING MERCHANTS. The terms, conditions, warranties and representations associated with any transactions between a MEMBER and a PARTICIPATING MERCHANT in the PROGRAM are solely between the MEMBER and the PARTICIPATING MERCHANT. Please refer to each PARTICIPATING MERCHANT'S website for all terms and conditions relating to the merchant transaction, including but not limited to, guarantees, warranties, payment terms, shipping, delivery, taxes, return policies and processing of returns.
We make no warranties and disclaim responsibility for fulfillment of the transaction between a MEMBER and a PARTICIPATING MERCHANT. Rewards.com will make reasonable efforts to respond to any inquiries made by a MEMBER within thirty (30) days.
Our Use of Your Information
You agree to indemnify and hold Rewards.com, its PARTICIPATING MERCHANTS and their respective parents, subsidiaries, officers, directors, employees, agents and representatives harmless from any claim or demand, including reasonable attorney's fees, made by any THIRD PARTY due to or arising in any way out of: (i) your participation in the Rewards.com PROGRAM, (ii) any violation of this AGREEMENT by you, (iii) the violation, infringement or misappropriation by you, or another USER or MEMBER of the PROGRAM using your ACCOUNT, of any intellectual property or other right of any person or entity, or (iv) any pornographic, hate-related, threatening, libelous, obscene, harassing or otherwise objectionable or offensive material contained in any of the postings or other communications.

All CONTENT included or available on this SITE, including site design, text, graphics, interfaces, and the selection and arrangements thereof is a Copyright of Rewards.com and has all rights reserved, or is the property of Rewards.com and/or THIRD PARTIES protected by intellectual property rights. Any use of materials on the SITE, including reproduction for purposes other than those noted above, modification, distribution, or replication, any form of data extraction or data mining, or other commercial exploitation of any kind, without prior written permission of an authorized officer of Rewards.com is strictly prohibited.
Rewards.com trademarks may not be used in connection with any product or service that is not provided by Rewards.com, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Rewards.com. All other trademarks displayed on Rewards.com website are the trademarks of their respective owners, and constitute neither an endorsement nor a recommendation of those owners. In addition, such use of trademarks or links to the websites of PARTICIPATING MERCHANTS is not intended to imply, directly or indirectly, that those PARTICIPATING MERCHANTS endorse or have any participation with Rewards.com.
User Communication Preferences
MEMBERSHIP at Rewards.com implies that you agree to receive communications that are ACCOUNT related. Additionally, Rewards.com communicates to MEMBERS with periodic shopping-related emails that highlight COUPONS and special deals that are available to Rewards.com MEMBERS. You can UNSUBSCRIBE to receiving emails that are not account-related by either (i) visiting your ACCOUNT page and clicking on the PREFERENCES link, or following the UNSUBSCRIBE link in any of the emails. Since we need to communicate ACCOUNT information with you in order to operate our service, you cannot UNSUBSCRIBE from ACCOUNT related emails. Rewards.com does not send ACCOUNT emails unnecessarily.

Compliance & Governing Jurisdiction
This AGREEMENT is governed by and is construed under the laws of the State of Texas, U.S.A, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state laws. Claims may not be resolved through any form of class action. By participating in the PROGRAM, MEMBERS consent that venue for all suits will be in the Northern District of Texas or, if there's no federal jurisdiction, venue will be in Tarrant County, Texas. The AGREEMENT set forth herein supersedes all prior AGREEMENTS. The MEMBER assumes all knowledge of applicable law and is responsible for compliance with any such laws. The MEMBER may not use Rewards.com in any way that violates applicable state, federal, or international laws, regulations or other government requirements. The MEMBER further agrees not to transmit or submit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.
